{"id":122,"date":"2010-12-19T10:30:42","date_gmt":"2010-12-19T10:30:42","guid":{"rendered":"http:\/\/www.cimforest.in\/?p=122"},"modified":"2024-10-11T14:17:26","modified_gmt":"2024-10-11T13:17:26","slug":"principal-chief-cosnervator-of-forests-commissioner-nagpur-are-saving-corrupt-r-n-rai-ifs-for-five-years","status":"publish","type":"post","link":"https:\/\/cimforest.in\/?p=122","title":{"rendered":"PRINCIPAL  CHIEF CONSERVATOR OF FORESTS &#038;  COMMISSIONER NAGPUR ARE SAVING CORRUPT R.N.RAI IFS FOR FIVE YEARS"},"content":{"rendered":"<p>Nagpur:\u00a0 On a very serious complaint of corruption against R.N.Rai, IFS the then DCF Nagpur, an enquiry was ordered by the Commissioner Nagpur division on 12-5-2004 \u00a0to find out corruption in construction of Kanholi-Baramathathi &amp; Mathadi \u2013 Kokardi roads in Nagpur under EGS. <strong>It was established in the enquiry during 2005 that a sum of Rs 16.72 lacs was mis-appropriated by R.N.Rai IFS and his other conspirators<\/strong>. But till now no action whether criminal or administrative has been initiated against them. Commissioner Nagpur and Principal Chief Conservator of Forests, Maharashtra state had \u00a0managed to hush-up the case, hence no action was initiated even after enquiry report was submitted in 2005 of such huge embezzlement of government money.<\/p>\n<p>The inquiry was conducted by Executive Engineer (EGS), Vigilance, cell in the\u00a0 office of the Commissioner Nagpur division. The Executive Engineer had submitted<a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2010\/12\/Nagpur-EGS-Enq-report.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"> inquiry report to Commissioner Nagpur<\/a>. In the inqury, four serious issues were framed to be inquired viz, :<\/p>\n<ol>\n<li> Whether as per provisions in estimates, for construction of road, instead of bringing different size of broken stones ( 80 mm, 40 mm ) from designated stone quarries ,\u00a0 unbroken round-stones from neighbouring forest area were collected and used for construction of road, thus \u00a0making the quality of road very inferior.<\/li>\n<li>Whether instead of using sanctioned quarries for murrum collection, agricultural soil mixed with murrum was collected from neighbouring agricultural fields &amp; forest; and\u00a0 these soil-mixed-murrum were used in lieu of murrum in construction of said roads, making quality of road construction of very inferiour quality ?<\/li>\n<li>Thus whether these officials have mis-appropriated money in :\n<ol>\n<li> Quarrying of these stones and murrum and breaking of stones of various sizes,<\/li>\n<li> Transportation of these material showing leads from the quarries shown in the estimates,<\/li>\n<li> Collection of round stones and soil from forest area in violation of Forest Conservation Act 1980 and\u00a0\u00a0\u00a0\u00a0\u00a0 in violation of Indian Forest Act 1927 ?<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p>4.\u00a0 Whether instead of local workers as stipulated in EGS Act, workers were brought from Madhya Pradesh and\u00a0\u00a0 they\u00a0 constructed the said roads ?<\/p>\n<p>5.\u00a0 Whether labourers were paid lesser amount than the actual amount charged against their names, which lead a labourer to commit suicide?<\/p>\n<p>6.\u00a0 Whether there was corruption and embezzlement of government money to the tune of Rs 20 lacs by these forest officials ?<\/p>\n<p>The enquiry report has categorically mentioned that :<\/p>\n<ol>\n<li><strong>There was mis-apropiation of Rs 16.72 lacs of government money. <\/strong><\/li>\n<li>Constructed roads were absolutely unfit\u00a0 even for pedestrians what to talk of motor vehicles since stones and murrum were not used as required and round collected stones were used, which are unfit to hold the murrum and road.<\/li>\n<li>80 mm and 40 mm broken stones were not used in construction of roads and all the records were bogus, the amount shown for breaking of stones was misappropriated.<\/li>\n<li>murrum was also not brought from sanctioned murrum quarries but agricultural soil was used for construction of road.<\/li>\n<li> measurement books of the road works were not filled up and maintained incompletely .<\/li>\n<li>almost all the labourers used and shown in the construction of roads were brought from Madhya Pradesh in violation of various rules and EGS Act. Hence all the mustor rolls and other documents showing labourers were bogus and forged.<\/li>\n<\/ol>\n<p>On this enquiry report Commissioner Nagpur vide his letter dated 6-4-2005 asked Suprindending engineer PWD, Nagpur to fixed up exact amount of misappropriated amount. The <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2010\/12\/Nagpur-EGS-SE-Report.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">SE (PWD) vide his letter dated 12-7-2005<\/a> reported to the Divisional Commissioner Nagpur that an amount of Rs 18,99,863\/- has been misappropriated by these officials of Nagpur Forest division\u00a0 headed by R.N. Rai IFS.<\/p>\n<p>The SE (PWD) in its report also mentioned that as per <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2010\/12\/Nagpur-EGS-GR.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">GR of Planning department no. EGS 1203\/CR-45\/EGS 2 dated 28-8-2003<\/a>, notices were issued to all concerned official for\u00a0 joint measurement of the works under inquiry. It is extremely important to understand that R. N.Rai being the DCF Nagpur was duty bound to follow mandatory joint measurement, which he too had to perform atleast 5% of the total work along with other members of joint inspection team. But Rai refused to do that by informing S.E. PWD that his presence is not required. This act of Rai was in total violation of Government order dated 28-8-2003. Thus Rai avoided joint measurement of non-performed works, of which he was the kingpin.<\/p>\n<p>Surprisingly, it took Commissioner Nagpur two years to get report of fixation of individual financial culpability, when Superintending Engineer PWD vide <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2010\/12\/Nagpur-EGS-responsibilty.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">letter dated 25-5-2007<\/a> has fixed up\u00a0 person wise financial recovery, which has not been recovered from any culprit as yet.<\/p>\n<p><strong>WHAT\u00a0 ACTIONS WERE NEEDED IN THE CASE:<\/strong><\/p>\n<ol>\n<li>An FIR was required to be booked for the violation of sections 7 &amp; 13 of Prevention of Corruption Act 1988 , \u00a0sections 161, 164, 166, 174, 463, 464, 470, 474, 477A &amp; 120 of Indian penal code , &amp; section 26 &amp; other relevant sections of Indian Forest Act, 1927 against R.N. Rai \u00a0IFS and others.<\/li>\n<li>Disciplinary proceedings for violating All India Services ( Conduct) Rules were required to be initiated after placing R.N.\u00a0 Rai IFS under suspension as per AIS (D&amp;A) Rules, since government has placed many All India services officials under suspension for much less mis-appropriation of government money.<\/li>\n<li>R.N.Rai IFS should have been kept on any functional and non-executive post till he is cleared from the charges.<\/li>\n<li>Departmental action is required to be taken against guilty PCCF and Commissioner Nagpur division for shielding the corrupt officials.<\/li>\n<\/ol>\n<p><strong>What Government has done till now:<\/strong><\/p>\n<p><strong> <\/strong><\/p>\n<ol>\n<li><strong>For last six years this case is being hushed up successfully at the Government, Commissioner Nagpur division &amp; PCCF\u2019s level. It is very unfortunate that this is a case where enquiry report had been submitted five years ago without any action till now.<\/strong><\/li>\n<li><strong> <\/strong>Always rewarded R.N. Rai by posting him on such posting where he could play with government money by adopting corrupt practices.\u00a0 That too when Government is in complete know of his serious corrupt practices.<\/li>\n<li>Regularly promoting him from JA grade to Selection grade to Super-time scale\u00a0 of IFS and promoting them from Deputy Conservator of Forests to Conservator of Forests.<\/li>\n<li>No question is asked from PCCF or Divisional Commissioner Nagpur for such inordinate &amp; unexplained delay for this inaction.<\/li>\n<\/ol>\n<p><strong> <\/strong><\/p>\n<p><strong>Dear Readers , we will keep informing you the progress of the case and trying to expose any attempt to hide and burry this very important environmental issue.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nagpur:\u00a0 On a very serious complaint of corruption against R.N.Rai, IFS the then DCF Nagpur, an enquiry was ordered by the Commissioner Nagpur division on 12-5-2004 \u00a0to find out corruption in construction of Kanholi-Baramathathi &amp; Mathadi \u2013 Kokardi roads in Nagpur under EGS.
