GAD 1608\/CR 47\/08\/11A dated 1-11-2008<\/a> , the office of the Head of the Forest force, Maharashtra state , Nagpur has admitted knowing the stories of corruptions with hard evidences against forest officers, but refused to initiate the action. According to them, question does not arise for any action even if they are neck deep involved in corruption.<\/p>\n<p>On a requisition under RTI Act 2005 by one Dr Raghuvanshi, PIO of PCCF office, Nagpur has informed to Dr Raghuvanshi <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/05\/PCCF-denial-RTI.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">vide his letter dated 26-4-2011<\/a> that PCCF office is aware of stories with evidences being published on <a href=\"http:\/\/www.cimforest.in\" target=\"_blank\" rel=\"noopener noreferrer\">www.cimforest.in<\/a> against senior IFS officers of Maharashtra cadre, but he refused to give the information stories-wise on the pretext that the said information is available with different desks in the same office of PCCF.\u00a0 It is very surprising that though as per section 6 (3) of the RTI Act, 2005,\u00a0 PIO is mandated and duty bound to send the portion of requisition of information to the other relevant PIO and he can not deny information on the ground that one should send separate requisition letters to different PIOs in the same office.<\/p>\n<p>Rule 6 (3) of PIO reads as follows:<\/p>\n<p><strong> <\/strong><\/p>\n<table border=\"0\" cellpadding=\"0\" width=\"464\" height=\"606\">\n<tbody>\n<tr>\n<td width=\"7%\" valign=\"top\"><strong>6<\/strong><\/td>\n<td width=\"6%\" valign=\"top\">(1)<\/td>\n<td width=\"6%\" valign=\"top\"><\/td>\n<td width=\"81%\">A person, who desires to   obtain any information under this Act, shall make a request in writing or   through electronic means in English or Hindi or in the official language of   the area in which the application is being made, accompanying such fee as may   be prescribed, to\u2014<\/td>\n<\/tr>\n<tr>\n<td width=\"7%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\">(a)<\/td>\n<td width=\"81%\">the   Central Public Information Officer or State Public Information Officer, as   the case may be, of the concerned public authority;<\/td>\n<\/tr>\n<tr>\n<td width=\"7%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\">(b)<\/td>\n<td width=\"81%\">the   Central Assistant Public Information Officer or State Assistant Public   Information Officer, as the case may be,&nbsp;<\/p>\n<p>specifying the particulars of the information sought by him or her:<\/p>\n<p>Provided that where such request cannot be made in writing, the Central   Public Information Officer or State Public Information Officer, as the case   may be, shall render all reasonable assistance to the person making the   request orally to reduce the same in writing.<\/td>\n<\/tr>\n<tr>\n<td width=\"7%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\">(2)<\/td>\n<td width=\"6%\" valign=\"top\"><\/td>\n<td width=\"81%\">An applicant making   request for information shall not be required to give any reason for   requesting the information or any other personal details except those that   may be necessary for contacting him.<\/td>\n<\/tr>\n<tr>\n<td width=\"7%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\">(3)<\/td>\n<td width=\"6%\" valign=\"top\"><\/td>\n<td width=\"81%\"><span style=\"color: #ff0000;\"><strong>Where an application is made to a   public authority requesting for an information,\u2014<\/strong><\/span><\/td>\n<\/tr>\n<tr>\n<td width=\"7%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\"><span style=\"color: #ff0000;\">(i)<\/span><\/td>\n<td width=\"81%\"><span style=\"color: #ff0000;\"><strong>which is held by another public   authority; or<\/strong><\/span><\/td>\n<\/tr>\n<tr>\n<td width=\"7%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\"><\/td>\n<td width=\"6%\" valign=\"top\"><span style=\"color: #ff0000;\">(ii)<\/span><\/td>\n<td width=\"81%\"><span style=\"color: #ff0000;\"><strong>the subject matter of   which is more closely connected with the functions of another public   authority,the public authority, to which such application is made, shall transfer the   application or such part of it as may be appropriate to that other public authority   and inform the applicant immediately about such transfer: <\/strong>&nbsp;<\/p>\n<p><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong> <\/strong><strong>Provided that the transfer of an application pursuant to this sub-section   shall be made as soon as practicable but in no case later than five days from   the date of receipt of the application<\/strong><\/p>\n<p><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"color: #0000ff;\"><strong>Dear Readers, it would be an experience for you to read the <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/05\/PCCF-denial-RTI.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">reply given by PIO of the office of the Principal Chief Conservator of Forests, MS , Nagpur<\/a> instead of we reproducing it here.<\/strong><\/span><\/p>\n<p><strong><span style=\"color: #ff0000;\">REASONS FOR NOT SUPPLYING THESE INFORMATION BY HOFF:::<\/span><\/strong><\/p>\n<p>Through reliable sources we came to know that HOFF MS has not provided these information against senior IFS officers of Forest department since almost all of them were due for promotions. It is really courageous\u00a0 of the PIO and office of the PCCF that to shield officers they have defied the LAW and provisions of the departmental inquiry against officers\u00a0 as per provisions of said GR.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>ACTION REQUIRED IN THE MATTER::<\/strong><\/span><\/p>\n<ol>\n<li>The guilty PIO should immediately be punished for not following the dictate of law, as provided in the GR.<\/li>\n<li>The HOFF office , who says that there is no question of initiating any inquiry against corrupt officers should apply its mind again to avoid serious embarrassment in future.<\/li>\n<\/ol>\n<p><em><span style=\"color: #ff0000;\"><strong>Dear Readers, CIM will follow this story very closely to take it to its logical conclusions.<\/strong><\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a bizarre incident of shielding corruption and not initiating disciplinary action against\u00a0 prima face guilty senior forest officers of Maharashtra cadre as per provisions of GR no.
