DC PANT PCCF W\/L misled the Legislature while anwering a calling attention motion on the subject::Exemplary punishment required:"},"content":{"rendered":"<p>In a blatant violation of provisions of :<\/p>\n<ul>\n<li>Forest Conservation Act, 1980<\/li>\n<li>NTCA (National Tiger Conservation Authority) guidelines (WLP Act 1972),<\/li>\n<li>Maharashtra Treasury Rules, 1968,<\/li>\n<li>Bombay Forest Manual &amp; various Government resolutions,<\/li>\n<li>Chief Wildlife Warden\u2019s standing instructions<\/li>\n<\/ul>\n<ol>\n<li><strong> <\/strong><strong>Nand Kishore IFS<\/strong> the then CCF Wild Life Nagpur, <strong> <\/strong><\/li>\n<li><strong>S.H. Patil, IFS<\/strong> the then Director , Tadoba National Park, <strong> <\/strong><\/li>\n<li><strong>Mohan Jha IFS <\/strong>the then Field Director Pench Tiger Reserve and<strong> <\/strong><\/li>\n<li><strong>Anil Saxena IFS<\/strong> (as reported by<a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-AG-Report-28-9-2010.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"> AG in it\u2019s report,<\/a> though CIM has not reached it\u2019s finding on him as yet)<\/li>\n<\/ol>\n<p>had misappropriated Government money to the tune of approx Rs \u00a03 crores \u00a0with the help of one NGO viz. Gramapayogi Vigyan Kendra (Centre of science for villages), Duttpur, Wardha. When this story was broken by SP Thakare IFS, who took charge of Field Director Tadoba National Park from SH Patil, vide his <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-16-9-20091.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">letter dated 16-9-2009<\/a> addressed to Chief Conservator of Forest, W\/L Nagpur and vide <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-to-pccf-11-2-2010.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">letter dated\u00a0 11-2-2010 to\u00a0 PCCF WL<\/a>, instead\u00a0 of taking action against guilty forest officers, cover up operation started . Dr Nand Kishore was CCF W\/L Nagpur at that time.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Serious criminality and Financial Irregularities in Tadoba National Park :<\/strong><\/span><\/p>\n<p><strong> <\/strong>As per documents available with CIM, in Tadoba National Park, entire money was drawn without any completion or in most of the cases start of\u00a0 work. \u00a0Once this misappropriation was brought to the notice of Dr Nand Kishore by new Field Director of Tadoba , Sanjay Thakre,\u00a0 Field Director was asked to get the job completed by the said Gramapayogi Vigyan Kendra after six months of the full payment made to them <strong>in the next financial year<\/strong>.\u00a0 Thus it is case of misappropriation of government money and when theft was made public, they started completing the works of construction. <strong>Result: Whistle blower was transferred because of clout of these \u00a0holy cows<\/strong>.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Sanctioning of Project under gross violation of FC Act:<\/strong><\/span><\/p>\n<p>On <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/06\/ST-Prposal-12-5-2008.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">12-5-2008, the Field Director Tadoba<\/a> had sent a continuous proposal of Rs 80 lacs to government through CCF WL Nagpur for Eco-tourism works. The close look of the same would reveal that these works include;<\/p>\n<ul>\n<li>Canteen waiting room,<\/li>\n<li>Construction of Holiday home and its beautification<\/li>\n<li>Road constructions,<\/li>\n<li>Boundary fencing<\/li>\n<li>Souvenirs shop<\/li>\n<li>Interpretation centre<\/li>\n<\/ul>\n<p>None of these items can be made in the Tiger reserves without clearence under FC Act, as informed by Government of India.<\/p>\n<p>Government of Maharashtra vide <a href=\"http:\/\/www.cimforest.in\/uploads\/2011\/06\/ST-GR-2-3-2009.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">GR dated 2-3-2009<\/a> has sanctioned under the head \u201c Sanrakshit kshetrateel Nisarg Paryatan Vikas\u201d for the financial year 2008-09<\/p>\n<ul>\n<li>Rs 95 lacs\u00a0 for Tadoba national Park.<\/li>\n<li>Rs 1 crore 9 lacs for Pench Tiger Reserve<\/li>\n<\/ul>\n<ul>\n<li><strong>While sanctioning this financial provisions, Government Resolution was very categorical that under no condition there should be any breach of provisions of Forest Conservation Act<\/strong>. This was the only specific condition of GR dated 2-3-2009.<\/li>\n<\/ul>\n<p>Government has accorded administrative sanction vide <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/06\/ST-GR-4-2-2009.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">GR dated 4-2-2009<\/a> for construction of Holiday home and well furnished waiting room in Tiger \u2013Andheri Tiger Reserve for the year 2008-09. This was also in gross violation of FC ACT and NTCA guidelines.<\/p>\n<p><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><strong>Siphoning of Government money against the established Laws, Rules &amp; Regulations through \u00a0one NGO in active collaboration by these holy cows:<\/strong><\/span><\/span><\/p>\n<ol>\n<li><strong> <\/strong><span style=\"color: #0000ff;\"><strong>Modus operandi of these Corrupt officials:<\/strong><\/span><\/li>\n<\/ol>\n<ul>\n<li>a)\u00a0\u00a0\u00a0\u00a0\u00a0 Once financial and administrative sanction were obtained, these \u00a0IFS officers ( Dr Nand Kishore, Dr Mohan Jha, Anil Saxena &amp; \u00a0S.H.Patil) \u00a0hatched a criminal conspiracy and without calling for open Tenders as required \u00a0under the financial rules and regulations; granted the job of construction to their favoured NGO, \u00a0\u201cCentre for science for villages, Dattapur, Wardha\u201d. <strong>It is very important to understand that whether it is Chandrapur, Bhandara or Nagpur district, there was only this NGO, who was allotted such huge works without calling tenders\u00a0 and all these areas were under Nand Kishore.<\/strong><\/li>\n<li>b)\u00a0\u00a0\u00a0\u00a0\u00a0 Though there are government of Maharashtra\u2019s various GRs indicating that public tenders must be called, when job to be awarded on contract is of more than Rs 2 lacs. Even <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/CCF-WL-MS-standing-order.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Forest department\u2019s circular dated 11-2-1993<\/a> also categorically mentions for open tenders to be called, if value of contract is more than Rs 2 lacs; but these officials had not called any tender for the same and works of crores had been allotted to the said NGO for their personal shares.<\/li>\n<li>c)\u00a0\u00a0\u00a0\u00a0\u00a0 Very surprisingly, Field Directors have entered in an <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-MOU.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">MOU on Rs 100\/- stamp paper<\/a> with Centre of Science for Villages, Dattapur-Wardha. One such MOU\u00a0 dated 24-10-2008 is attached here.\u00a0 Where from these officials have got this idea of entering into an MOU with very objectionable conditions, is not known to CIM.<\/li>\n<li>d)\u00a0\u00a0\u00a0\u00a0 It seems these holy cows \u00a0had got the idea from a <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-Tribal-GR-2-3-2009.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">tribal department GR dated 30-7-2008,<\/a> which is squarely applicable for Government of India\u2019s Central Special assistance scheme for constructions of houses for tribals. But by no stretch of imagination this GR could be applicable in the case of Eco-tourism schemes of Government of Maharashtra.<\/li>\n<li>e)\u00a0\u00a0\u00a0\u00a0\u00a0 These holy cows have put a very strange condition in said MOU at s.no. 3, which reads as <strong>,\u201d Payment under Its MOU: Payment to the second party (read NGO) for the construction of work will be released by the First party ( read as Field Director) as an advance:- <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-MOU.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">On signing the agreement\u00a0 :\u00a0 100% of the total cost<\/a><\/strong>.\u201d<\/li>\n<li>f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Hence, against all provisions of financial rules, 100% payment was made to the NGO without any start of work.<\/li>\n<li>g)\u00a0\u00a0\u00a0\u00a0\u00a0 As per the condition of the said MOU, all the works were required to be completed by 21-3-2009.<\/li>\n<li>h)\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Holy cows ensured that there were no measurement books of these works\u00a0 maintained\u00a0 till whole episode was opened by Thakare.<\/strong><\/li>\n<li>i)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 No work order was released to contractor, because to release the work order,\u00a0 EMD of 1% and security of 2% deposit \u00a0were required from the contractor as per <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/CCF-WL-MS-standing-order.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">CCF WL MS circular dared 11-2-1993<\/a>.<\/li>\n<li>j)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 While making payment , as per Government order 4% VAT was required to be deducted, if VAT was exempted, even then 2% VAT was required to be deducted, which was not done in any case for this NGO.<\/li>\n<li>k)\u00a0\u00a0\u00a0\u00a0\u00a0 While making payment to the contractor, as per government directives issued from time to time, Income tax @ 2%, Surcharge @ 10% and Education cess @ 3% were required to be deducted and deposited in the treasury.<\/li>\n<li>l)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 All these were reported by Thakare to Nand Kishore vide letter dated 16-9-2009\u00a0 and\u00a0 to \u00a0A.K.Joshi, the then <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-to-pccf-11-2-2010.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">PCCF wild life vide letter dated 11-02-2010<\/a>.m)\u00a0\u00a0\u00a0 No permission under Forest Conservation Act, 1980 was obtained at any place.<\/li>\n<\/ul>\n<p><span style=\"color: #ff0000;\"><strong>2.\u00a0 Applicable Financial Rules in this case:<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong><a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/Treasury-Rules.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 380 of Maharashtra Treasury Rules 1968<\/a><\/strong><\/span> reads as follows:<\/p>\n<ul>\n<li>a)\u00a0\u00a0\u00a0\u00a0\u00a0<em><span style=\"color: #0000ff;\"> <strong>\u201cPayments to suppliers &amp; contractors<\/strong>:\u00a0 Unless in any case the Government after consultation with the Accountant General directs otherwise, payments for all the works done other-wise than by daily labour and for all supplies <strong>shall be made on the basis of measurement recorded in the measurement books<\/strong> kept for the purpose. Claims for such payments shall be prepared as far as possible by the claimants themselves in authorized form of bills and vouchers and no payment other than an advance payment\u00a0 may be authorized unless the correctness of claim in in respect of quantities and rates, as well as the qualities of the work done or supplies made have been accepted and all calculations carefully checked by a responsible officer.\u201d<\/span><\/em><\/li>\n<\/ul>\n<p><span style=\"color: #ff0000;\"><strong><a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/BFM-Rule-200.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 200 of Bombay Forest Manual Vol 1, chapter XIX<\/a><\/strong><\/span> reads as follows:<\/p>\n<ul>\n<li>b)\u00a0\u00a0\u00a0\u00a0\u00a0<span style=\"color: #0000ff;\"><em> No money should be withdrawn from the treasury unless it is required for the immediate payment. It is not permissible to draw advances from the treasury either for prosecution of works, completion of which is likely to take considerable time or to prevent of lapse of appropriation.\u201d<\/em><\/span><\/li>\n<\/ul>\n<p><a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/BFM-Rule-200.jpg\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff;\"><strong>Rule 202 of Bombay Forest Manual Vol 1, chapter XIX<\/strong> <\/span><\/a>reads as \u00a0follows:<\/p>\n<ul>\n<li><span style=\"color: #0000ff;\"><em>c)\u00a0\u00a0\u00a0\u00a0\u00a0 All charges incurred must be paid and drawn at once and under no circumstances may they be allowed to stand over to be paid from the grant of another year. If possible, expenditure should\u00a0 be postponed till the preparation of new budget has given an opportunity of making provision and till the sanction of that budget has supplied means. But on no accounts the charges be actually incurred in one year and thrown on the grants of another year\u201d.<\/em><\/span><\/li>\n<li>d)\u00a0\u00a0\u00a0\u00a0 Circular issued by Chief Conservator of Wild life MS, <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/CCF-WL-MS-standing-order.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Nagpur dated 11-2-1993<\/a>.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><strong>Thus there is no confusion on following points as far as Financial irregularities are concerned:<\/strong><\/span><\/span><\/p>\n<ul>\n<li><span style=\"color: #ff0000;\"><strong> <\/strong><\/span>a)\u00a0\u00a0\u00a0\u00a0\u00a0 No work of construction, which is more than Rs 2 lacs, can be given without inviting tenders.<\/li>\n<li>b)\u00a0\u00a0\u00a0\u00a0\u00a0 No payment can be made to the contractor until and unless measurement has been taken, recorded and verified.<\/li>\n<li>c)\u00a0\u00a0\u00a0\u00a0\u00a0 No payment can be made until and unless quality of the work done, is ascertained and verified by a responsible officer.<\/li>\n<li>d)\u00a0\u00a0\u00a0\u00a0 Work order can not be issued until and unless 1% earnest deposit and 2% security deposit are taken from contractor .<\/li>\n<li>e)\u00a0\u00a0\u00a0\u00a0\u00a0 Payment can not be made until and unless 2% Income tax TDS, 4% VAT and 3% education cess are deducted from the paid amount.<\/li>\n<li>f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 All charges incurred must be paid and drawn at once and under no circumstances may they be allowed to stand over to be paid from the grant of another year. And this can be done only when work has been completed in the same financial year.<\/li>\n<\/ul>\n<p><strong>NONE OF ANY ABOVE SAID CONDITIONS WERE FOLLOWED IN THIS MEGA CORRUPTION CASE.<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><strong>Special celestial situation at HOFF office at Nagpur:<\/strong><\/span><\/span><\/p>\n<p>When all these extremely serious financial misappropriation was going on in Tadoba &amp; Pench, a <strong>very unique celestial situation , which occurs once in a million year, occurred<\/strong>. HOFF- CS Joshi, PCCF WL-AK Joshi, CCF WL Nagpur-Nand Kishore &amp; PCCF WL in pipeline-DC Pant, all these officers were\u00a0 from the same small area of Uttarakhand state in India. \u00a0This was the Kavach &amp; Kundal of Nand Kishore and he survived and instead of getting suspended, got promotion to the APCCF because of these four holy cows.<\/p>\n<p><strong> <\/strong><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><strong>Criminal Conspiracy &amp; Execution of ill-sanctioned work under gross violations of FOREST CONSERVATION ACT\u00a0 1980 &amp; NTCA guidelines:<\/strong><\/span><\/span><\/p>\n<ol>\n<li><span style=\"color: #ff0000;\"><strong> <\/strong><\/span>It can be seen that Government of India has very categorically informed vide <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-RTI-28-12-20101.pdf\">letter dated 28-12-2010<\/a> that even for construction of Eco-Tourism complexes, even for Forest officers, permission is required under FC ACT 1980.<\/li>\n<li>Similarly, \u201cNTCA of Government of India vide <a href=\"http:\/\/cimforest.in\/wp-content\/uploads\/2011\/07\/ST-NTCA-4-4-2011.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">letter No. 10-32\/2010-NTCA, dated 29-12-2010 <\/a>has clarified that clearance is required under FC Act, 1980 for any non-forestry activity including th construction of Eco-tourism complexe and interpretation centre on forest land including the protected area. The provisions of the Act are applicable on the Forest officials as well\u201d. This was informed by Government of India vide letter dated 4-4-2011.<\/li>\n<\/ol>\n<p><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><strong>Complaints and Cover up of this corruption:<\/strong><\/span><\/span><\/p>\n<p><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000;\"><strong>Dear Readers.
